General terms and conditions for renting La Gioiella
La Gioiella is a trade name of the individual company Mag. Christian FRASS and designates the object to be rented. The rental agreement has been concluded between you as a tenant and the individual company as the sole proprietor. These general terms and conditions apply to the rental agreement concluded between the sole proprietor and the tenant. The rental of the property La Gioiella (referred to as “La Gioiella”) is always based on the following conditions, which form the basis of the rental agreement between the individual company and the tenant together with the annexes (user manual, rental documents). Additions to the lease are only effective if they are in writing.
Booking procedure
If you want to make a booking, use the online option and start your reservation request. When you send the reservation request, you have not yet booked bindingly. Only when you receive a confirmation mail from the individual company the booking is binding.
Introduction
Before the arrival, the tenant receives rental documents, the description of the route and the exact location of the key to La Gioiella. On the booking day, the tenant must be at least 25 years old.
1. Rental period
The arrival and departure times stated on the rental documents are binding at any time. The rental documents indicate when La Gioiella can be obtained. La Gioiella must always be vacated by 10.00 a.m. on the day of departure. The key can normally be handed over only if the full rental price is paid and upon presentation of the confirmation e-mail. La Gioiella will be ready at 4.30 p.m. at the earliest on the day of arrival.
2. La Gioiella
2.1 Size of La Gioiella
The indicated house size on the website is the net area.
2.2 Number of persons
La Gioiella and the surrounding property may be inhabited to a maximum of the number of persons indicated on the homepage and the rental documents. This also applies to children regardless of age. If La Gioiella or the property is inhabited by more than the authorized persons, the individual company may, without notice, banish all the surplus persons from La Gioiella and the property. If this order is not delivered within 12 hours of the referral, the individual company has the right to terminate the rental agreement with immediate effect and without further notice to all persons of La Gioiella and the property. The rental price is not refunded in such a case.
La Gioiella is rented mainly to families, groups of people and couples. Youth groups – at least 6 people under 25 years of age – are of course welcome as well, but they must register as such when booking. The individual company is entitled to reject a group, provided that registration as a youth group has not taken place within a reasonable period of time before the start of the rental period.
2.3 Tents and caravans
The erection of tents or caravans on or near the property is not permitted. The individual company has the right to demand their immediate removal. If this arrangement is not followed immediately, the individual company has the right to terminate the rental agreement with immediate effect and without further notice to refer all persons of La Gioiella and the property. The rental price is not refunded in such a case. The proof remains to you that the damage caused to the individual company was less or not at all.
2.4 Pets and allergies
Pets are not allowed in La Gioiella. However, the sole proprietor can not guarantee that La Gioiella has never been pets or that the previous owner did not themselves own pets. The individual company accepts no responsibility for the allergic reactions of the tenant.
2.5 Noise
The tenant may be unexpectedly exposed to noise from logging and construction work, traffic or the like. The individual company can not be held responsible for noise.
Swimming pool
On the La Gioiella property there is a swimming pool which can be used by the tenant. For security reasons, the tenant is obliged to comply with each instruction of the individual company. The use of the pool is at your own risk. Children are allowed to be in the pool area only under the supervision of an adult. The swimming pool area is sealed by 2 doors. These doors are to be sealed again after use of the swimming pool, but at the latest after 8 pm.
3. Prices and payments
3.1 Rental price
The rental price for La Gioiella is given in EURO per week. The rental documents, which contain important information, such as arrival and departure dates, address and coordinates of the house, etc. will be sent after the entire rental price has been paid.
3.2 Terms of payment
When booking more than 56 days before arrival:
- Rate (50%) Payment received 8 days after receipt of the booking
- Rate (50%) Payment received 42 days before the start of the rental period
For bookings 55-42 days before arrival:
Full rate (100%) Payment received 3 days after receipt of booking
When booking 41-00 days before arrival:
Full rate (100%) Payment received immediately after receipt of booking. If the payment periods are not adhered to, this is regarded as non-fulfillment and the individual company is entitled without notice to terminate the existing rent. However, the individual company will try to inform the tenant as soon as possible. Cancellation of the rental agreement for this reason does not release the tenant from the payment obligation of the rent and takes place according to point 3.
3.3 Payment method

The prices given on the website www.tuscanyspirits.com are final prices including fixed, obligatory ancillary costs. There is also a tourist tax. If nothing else is stated on the homepage, the rental price is the price including consumption of electricity, gas or similar as well as heating (including firewood/pellets) as well as water. The prices are given in EURO. Charging of electric vehicles is not included.
4. Price increases
In the case of price increases, increased taxes, duties or currency fluctuations occurring 21 days before the start of the rental period, the individual company is entitled to increase the rental price against documentation by up to 5%.
5. Cancellation, replacement, rescission, rebooking, non-arrival of the trip
5.1 Cancellation
A cancellation can only be made by e-mail to the following e-mail address: mail@tuscanyspirits.com and is only effective from the date of receipt at the individual company.
5.2 Cancellation conditions
If a booking is canceled, the following charges apply. However, the proof shall be given to you that the resulting damage or loss incurred to us has been incurred less or not at all.
- A) from the booking date and up to 60 days before the start of the rental period, 20% of the total rental amount
- B) from 59 to 36 days before the start of the rental period, 50% of the total rental amount
- C) from 35 days before the start of the rental period 80% of the total rental amount
If the individual company does not receive a cancellation according to 5.1, 100% of the total rental amount will forfeit, even if La Gioiella was not rented. The fee is rounded up to EURO. The proof remains to you that the damage caused to the individual company was less or not at all.
5.3 Replacement Rental
If La Gioiella is rented instead at the full rate, the fees stated in section 5.2. C) are being reduced to a fee of 25% of the total rental amount. If La Gioiella can not be rented or La Gioiella is not rented at full price, the fees mentioned in point 6.2 are valid.
If the tenant is allowed to designate another tenant in the same period and at the same price in his place, the individual company accepts a change of name for a fee of EURO 50,-. The notification must be sent to the individual company by e-mail in accordance with point 5.1. The individual company accepts, as far as possible, a transfer of the original rental agreement until the 42nd day before the start of the rental period for a fee of EURO 50,-. Any rebooking of the original rental agreement from and with the 42nd day before the start of the rental period and subsequently is considered as a cancellation (according to the aforementioned conditions) with subsequent booking. The separation of the days mentioned in points 5.2 and 5.3 takes place in the preceding midnight.
6. Security deposit
The deposit of EURO 500, – (in words: five hundred) is levied at the time of payment of the rent or cash at the key handover. The deposit serves to protect the interests of the owner of La Gioiella in case of any damage to the rental property or the lack of a final cleaning. The reckoning of the deposit is made no later than 3 weeks after departure from La Gioiella. Any damages and a final cleaning fee plus a processing fee will be deducted from the deposit before repayment. If the value of the deductions mentioned exceeds the amount of the deposit, the remaining amount will be invoiced to the tenant.
7. Final cleaning
The tenant is obliged to leave La Gioiella tidy and thoroughly cleaned. The tenant must pay particular attention to the cleaning of the refrigerator, freezer, stove, oven, grill and sanitary facilities. The final cleaning is obligatory and is usually ordered for payment by the individual company. Taking account of the responsibility towards the individual company, the tenant is not allowed to leave the cleaning to a third party.
Costs for missing or defective final cleaning will be charged to the tenant. Also the ordered and obligatory final cleaning is incumbent upon the tenant the obligation to wash and dispose of the dishes, clearing the refrigerator and tidying up inside and outside La Gioiella. They also have the possibility to ask for an additional cleaning after 14 days in the case of rental periods of more than 21 days and then after each additional week.
The obligatory final cleaning is EUR 35, – per person, but at least EUR 180, -. The costs for the obligatory final cleaning are to be paid on site.
8. Damage
The tenant is responsible for handling the rental property carefully and returning it in the same state as it was taken over. Exceptions are ordinary reductions due to wear and tear. The tenant is responsible for the damage caused to the object and / or inventory during the stay, regardless of whether the tenant himself or others, who have received the tenant’s access to La Gioiella and it´s properties, are responsible for the property. Damage to the object and / or the inventory caused during the stay must be reported to the individual company immediately.
Complaints resulting from damage caused during the rental period will be claimed within one month after expiry of the rental period, if the defect is registered or can be recognized by ordinary care, unless the tenant has been negligent. The individual company controls La Gioiella at every change of tenant to ascertain whether defects or damage to the property La Gioiella and / or the inventory as well as any missing or deficient cleaning are available.
9. Obligations of the traveler
9.1 During the trip
If the tenant detects a faulty cleaning, damage or deficiencies at La Gioiella on arrival, it is the responsibility of the tenant to claim this immediately by e-mail. Complaints for cleaning must be carried out immediately. Complaints about damages or defects must be made as soon as possible and at the latest 72 hours after the start of the rental period or the determination of the defect or damage. Please note that you must always give the individual company a reasonable time to remedy the situation. An unreasonably short deadline automatically sets a reasonable deadline. If, however, you leave before the expiry of the deadline, this only applies to your legal and economic risk.
A reduction of the rentalprice can only be checked for the period for which a complaint has been lodged or has been omitted from you without fault. However, please do not forget that in any case you are obligated to do everything that is reasonably feasible to you in the event of possible performance problems in order to contribute to the elimination of the fault and to minimize any damage. Even before termination, you must provide a reasonable period for remedying one of the above, unless remedy is impossible or has already been refused, or if the immediate termination is justified by a special interest of yours.
9.2 After the trip
If, contrary to your expectations, you have claims for non-contractual delivery of the journey, you must register it with the individual company within one month after the agreed travel date.
10. Exceptional events
10.1 Force majeure
Insofar as the execution of the rental agreement is not possible or is substantially more difficult due to force majeure, e.g. war, natural and environmental disasters, drought, other unusual weather conditions, epidemics, closures, traffic conditions, suspension of foreign exchange trading, strikes, lockouts or similar force majeure that was not foreseeable during booking the individual company has the right to cancel the booking and can not be held responsible for such incidents of the kind mentioned. In cases of force majeure, the individual company is entitled to reimburse all costs incurred, including the booking expenses incurred in connection with the cancellation.
10.2 Insect or wild animal attack
The individual company can not be held responsible for insect or wild animal attacks on La Gioiella or its property, nor in the case of theft, damage or the like that is the property of the tenant.
11. Other information
It is recommended to read the website www.tuscanyspirits.com and the user manual on site. Smoking is not allowed in La Gioiella.

The individual company provides the guest rooms listed on the website, www.tuscanyspirits.com. The agreement for the renting of rooms is directly between you and the individual company.
2. Booking procedure

3.1 Rental price
The rental price for the respective guest room or the combination of the Purple & the Blue guest room is given in EURO per day. Price on request.
3.2 Minimum rental period
The minimum rental period is three nights.
3.3 Terms of payment
When booking more than 56 days before arrival:
- Rate (25%) Payment received 8 days after receipt of the booking
- Rate (75%) Payment received 42 days before the start of the rental period
For bookings 55-42 days before arrival:
Full rate (100%) Payment received 3 days after receipt of booking
When booking 41-00 days before arrival:
Full rate (100%) Payment received immediately upon receipt of the booking
If the payment periods are not met, this is considered as a non-fulfillment.

8. Smoking in the guest rooms
Smoking in the guest rooms is prohibited.
9. Departure
Unless otherwise agreed, the room must be vacated by 10.00 a.m. on the day of departure. The room is cleaned by the individual company. Please leave the room in the same state as it was taken over.
10. Defects in the object
Please report any deficiencies in the rented room immediately. Otherwise, you may be burdened by any damage.
11. Termination
The individual company is entitled to terminate the contract with immediate effect and to demand the immediate eviction and issuing of the guest room if you violate the duties of careness of La Gioiella. Such a case is particularly true if you: damage the guest’s bedroom and / or seriously violate the house rules and continue the infringement even after warning. The rental price is not refunded in such a case.
12. Exceptional events

6. Minimum number of participants
The minimum number of participants for performing the cooking saloon is three. If the number of participants is below the minimum number of participants, the individual company has the right to cancel the cooking saloon. In this case, the advance payments made are reimbursed in full. The deadline for the determination of the minimum number of participants is seven days before the start of the respective cooking saloon. The individual participants will be informed in writing about the cancellation. A liability for the participant thereby incurred costs is excluded.
7. Other
The participant of the cooking saloon grants consent to the use of photos for the homepage of the individual company and for marketing purposes in social and conventional media on which the participant is to be seen. The ideas and composition of dishes, menu sequences, products, etc., which are generated in the cooking saloon by the participants, remain the intellectual property of the individual company. The participant does not acquire any rights. The individual company is entitled to combine individual dates of the cooking saloon or to cancel the cooking saloon in case of unforeseen events such as illness or the events listed under point 12 “Exceptional events” of the General Terms and Conditions Bed & Breakfast for La Gioiella. In these cases the participants will be notified immediately by email and will be refunded in full. A liability for the participant thereby incurred costs is excluded. The General Terms and Conditions for renting La Gioiella and for bed & breakfast in La Gioiella are reasonable.

In the case of price increases, increased taxes, duties or currency fluctuations occurring 21 days before the start of the rental period, the individual company is entitled to increase the rental price against documentation by up to 5%.
5. Cancellation, replacement, rescission, rebooking, non-arrival of the trip
5.1 Cancellation
A cancellation can only be made by e-mail to the following e-mail address: mail@tuscanyspirits.com and is only effective from the date of receipt at the individual company.
5.2 Cancellation conditions
If a booking is canceled, the following charges apply. However, the proof shall be given to you that the resulting damage or loss incurred to us has been incurred less or not at all.
- A) from the booking date and up to 60 days before the start of the rental period, 20% of the total rental amount
- B) from 59 to 36 days before the start of the rental period, 50% of the total rental amount
- C) from 35 days before the start of the rental period 80% of the total rental amount
If the individual company does not receive a cancellation according to 5.1, 100% of the total rental amount will forfeit, even if La Gioiella was not rented. The fee is rounded up to EURO. The proof remains to you that the damage caused to the individual company was less or not at all.
5.3 Replacement Rental
If La Gioiella is rented instead at the full rate, the fees stated in section 5.2. C) are being reduced to a fee of 25% of the total rental amount. If La Gioiella can not be rented or La Gioiella is not rented at full price, the fees mentioned in point 6.2 are valid.
If the tenant is allowed to designate another tenant in the same period and at the same price in his place, the individual company accepts a change of name for a fee of EURO 50,-. The notification must be sent to the individual company by e-mail in accordance with point 5.1. The individual company accepts, as far as possible, a transfer of the original rental agreement until the 42nd day before the start of the rental period for a fee of EURO 50,-. Any rebooking of the original rental agreement from and with the 42nd day before the start of the rental period and subsequently is considered as a cancellation (according to the aforementioned conditions) with subsequent booking. The separation of the days mentioned in points 5.2 and 5.3 takes place in the preceding midnight.
6. Security deposit
The deposit of EURO 500, – (in words: five hundred) is levied at the time of payment of the rent or cash at the key handover. The deposit serves to protect the interests of the owner of La Gioiella in case of any damage to the rental property or the lack of a final cleaning. The reckoning of the deposit is made no later than 3 weeks after departure from La Gioiella. Any damages and a final cleaning fee plus a processing fee will be deducted from the deposit before repayment. If the value of the deductions mentioned exceeds the amount of the deposit, the remaining amount will be invoiced to the tenant.
7. Final cleaning
The tenant is obliged to leave La Gioiella tidy and thoroughly cleaned. The tenant must pay particular attention to the cleaning of the refrigerator, freezer, stove, oven, grill and sanitary facilities. The final cleaning is obligatory and is usually ordered for payment by the individual company. Taking account of the responsibility towards the individual company, the tenant is not allowed to leave the cleaning to a third party.
Costs for missing or defective final cleaning will be charged to the tenant. Also the ordered and obligatory final cleaning is incumbent upon the tenant the obligation to wash and dispose of the dishes, clearing the refrigerator and tidying up inside and outside La Gioiella. They also have the possibility to ask for an additional cleaning after 14 days in the case of rental periods of more than 21 days and then after each additional week.
The obligatory final cleaning is EUR 35, – per person, but at least EUR 180, -. The costs for the obligatory final cleaning are to be paid on site.
8. Damage
The tenant is responsible for handling the rental property carefully and returning it in the same state as it was taken over. Exceptions are ordinary reductions due to wear and tear. The tenant is responsible for the damage caused to the object and / or inventory during the stay, regardless of whether the tenant himself or others, who have received the tenant’s access to La Gioiella and it´s properties, are responsible for the property. Damage to the object and / or the inventory caused during the stay must be reported to the individual company immediately.
Complaints resulting from damage caused during the rental period will be claimed within one month after expiry of the rental period, if the defect is registered or can be recognized by ordinary care, unless the tenant has been negligent. The individual company controls La Gioiella at every change of tenant to ascertain whether defects or damage to the property La Gioiella and / or the inventory as well as any missing or deficient cleaning are available.
9. Obligations of the traveler
9.1 During the trip
If the tenant detects a faulty cleaning, damage or deficiencies at La Gioiella on arrival, it is the responsibility of the tenant to claim this immediately by e-mail. Complaints for cleaning must be carried out immediately. Complaints about damages or defects must be made as soon as possible and at the latest 72 hours after the start of the rental period or the determination of the defect or damage. Please note that you must always give the individual company a reasonable time to remedy the situation. An unreasonably short deadline automatically sets a reasonable deadline. If, however, you leave before the expiry of the deadline, this only applies to your legal and economic risk.
A reduction of the rentalprice can only be checked for the period for which a complaint has been lodged or has been omitted from you without fault. However, please do not forget that in any case you are obligated to do everything that is reasonably feasible to you in the event of possible performance problems in order to contribute to the elimination of the fault and to minimize any damage. Even before termination, you must provide a reasonable period for remedying one of the above, unless remedy is impossible or has already been refused, or if the immediate termination is justified by a special interest of yours.
9.2 After the trip
If, contrary to your expectations, you have claims for non-contractual delivery of the journey, you must register it with the individual company within one month after the agreed travel date.
10. Exceptional events
10.1 Force majeure
Insofar as the execution of the rental agreement is not possible or is substantially more difficult due to force majeure, e.g. war, natural and environmental disasters, drought, other unusual weather conditions, epidemics, closures, traffic conditions, suspension of foreign exchange trading, strikes, lockouts or similar force majeure that was not foreseeable during booking the individual company has the right to cancel the booking and can not be held responsible for such incidents of the kind mentioned. In cases of force majeure, the individual company is entitled to reimburse all costs incurred, including the booking expenses incurred in connection with the cancellation.
10.2 Insect or wild animal attack
The individual company can not be held responsible for insect or wild animal attacks on La Gioiella or its property, nor in the case of theft, damage or the like that is the property of the tenant.
11. Other information
It is recommended to read the website www.tuscanyspirits.com and the user manual on site. Smoking is not allowed in La Gioiella.
